Welcome to BloomOnCue. These Terms of Service ("Terms") govern your use of the BloomOnCue website and service operated by BloomOnCue LLC ("BloomOnCue," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms. If you don't agree, please don't use the service.
What BloomOnCue does
BloomOnCue is a subscription web service that helps couples coordinate flower deliveries timed to one partner's menstrual cycle. The service includes cycle prediction, delivery scheduling, partner-aware tips, and order management. Flowers themselves are coordinated through third-party florists; BloomOnCue is not a florist.
Eligibility
You must be at least 18 years old to use BloomOnCue. By creating an account, you confirm that you are 18 or older and that the information you provide is accurate. You are responsible for keeping your account credentials secure.
Account types
BloomOnCue has two account types, with different roles and responsibilities:
- Partner accounts are paying customers. They subscribe to BloomOnCue, set delivery preferences, and authorize the scheduling and fulfillment of flower orders.
- Subscriber accounts are invited by a partner. They log cycle data, control their privacy settings, and receive flowers. Subscribers do not pay; their account is included in the partner's subscription.
Both account types must consent to these Terms. The subscriber's data is provided voluntarily and can be revoked at any time.
Subscription, billing, and refunds
- BloomOnCue's subscription fee is $15 per month, billed in advance through Stripe.
- The platform subscription fee ($15/month) and flower fulfillment costs are separate. Refunds for flower deliveries are not provided through BloomOnCue and would need to be addressed directly with the florist or fulfillment service that handled the order.
- You can cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period.
- The subscription fee covers BloomOnCue's platform service only. Flowers themselves are billed separately at cost — we do not mark up flower prices.
- Refunds for the subscription fee are handled on a case-by-case basis. Email [email protected] if you have an issue.
- Flower orders that have already been placed with a florist generally cannot be refunded once fulfillment has begun.
Flower delivery
- BloomOnCue schedules and coordinates orders but does not directly grow, arrange, or deliver flowers. Delivery is handled by third-party florists.
- Delivery dates are calculated based on cycle predictions provided by the subscriber. Predictions are estimates and may not be exact, especially in the first few cycles.
- We do our best to ensure quality and reliability, but we cannot guarantee specific florists, exact arrangements, or that every delivery will arrive on the predicted date.
- If a delivery fails (florist unavailable, address invalid, weather event, etc.), we will notify the partner and either reschedule or refund the cost of the failed order.
- The partner is responsible for ensuring the delivery address is accurate and that flowers can be received there.
Cycle predictions
BloomOnCue's cycle predictions are based on the data the subscriber provides and standard cycle math. They are estimates, not medical advice or contraceptive guidance. Do not use BloomOnCue for fertility planning, contraception, or as a medical tool. If you have concerns about your menstrual cycle or reproductive health, please consult a qualified healthcare provider.
User content and conduct
You agree not to:
- Use the service to harass, threaten, or abuse anyone
- Provide false information about yourself or your partner
- Use the service to send unwanted communications or invite anyone who has not consented
- Attempt to access another user's account or data
- Reverse-engineer, scrape, or attempt to extract the underlying source code or data from the service
- Use automated tools or bots to interact with the service
- Attempt to disrupt, overload, or compromise the security of our systems
- Use the service for any illegal purpose
Violating these rules may result in immediate suspension or termination of your account.
Important: consent and respect
BloomOnCue is built on a model where the subscriber explicitly accepts the partner's invite and controls her own data and privacy settings. Do not invite anyone who has not personally agreed to join BloomOnCue. Sending an invite to a person who hasn't consented, or using BloomOnCue to track someone without their knowledge, is a violation of these Terms and may also violate applicable laws. We will terminate accounts that engage in this behavior.
Intellectual property
BloomOnCue, the BloomOnCue logo, and the website design are owned by BloomOnCue LLC and are protected by copyright and trademark laws. You may not copy, modify, or use them without permission.
You retain all rights to the content you provide to BloomOnCue (cycle data, symptom notes, etc.). By using the service, you grant us a limited license to use that content solely to operate the service for you. We do not use your content for any other purpose.
Termination
You can stop using BloomOnCue and delete your account at any time. Email [email protected] to request account deletion. We may also terminate or suspend your account if you violate these Terms or for any other reason at our discretion. If we terminate your account for any reason other than a Terms violation, we will refund any prepaid subscription fees on a prorated basis.
Disclaimers
BloomOnCue is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or completely secure. We do not warrant that cycle predictions will be accurate. We do not warrant that flower deliveries will arrive at any specific time or in any specific condition.
Limitation of liability
To the fullest extent permitted by law, BloomOnCue LLC, its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim related to the service is limited to the amount you paid to BloomOnCue in the 12 months preceding the claim, or $100, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold BloomOnCue LLC harmless from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the service or violation of these Terms.
Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms or the service will be resolved through binding arbitration in North Carolina, except that you may bring claims in small claims court if they qualify. You and BloomOnCue waive the right to a trial by jury and to participate in a class action.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we'll notify you by email and update the "Last updated" date at the top of this page. Continued use of BloomOnCue after the changes take effect means you accept the new Terms.
